Lincoln County Court System

Minnesota uses one trial-court level for Lincoln County: District Court. Lincoln County District Court is part of the Fifth Judicial District and has original jurisdiction in civil, family, probate, juvenile, criminal, traffic, and conciliation cases filed in the county. There is no separate county court, justice court, surrogate court, or independent probate court for Lincoln County court records.

The Fifth Judicial District administration office oversees courts in fifteen southwest Minnesota counties, but it does not hear Lincoln County cases. Case filings, hearings, court calendars, and certified court copies run through Lincoln County District Court and its Court Administrator. Appeals from district court usually go to the Minnesota Court of Appeals, with further review in the Minnesota Supreme Court when allowed.

Lincoln County Court Record Types

Lincoln County court records include several case categories because District Court is the county's trial court for nearly all state-court matters. Civil files may include complaints, answers, motions, affidavits, orders, judgments, and satisfactions. Conciliation cases are Minnesota small-claims cases within the district court system. Family files include divorce, custody, parenting time, paternity, child support, and related orders.

Criminal records include complaint, citation, probable cause, bail conditions, appearances, pleas, motions, trial events, disposition, sentence, restitution, fines, and probation terms. Traffic cases are district court or payable-citation matters handled through MCRO, WebPay, and the Court Payment Center. Probate records are District Court probate matters, not a separate local probate court. Juvenile, child-protection, civil-commitment, OFP, HRO, sealed, and confidential case types have stronger access limits.

Lincoln County Court Records Fields

MCRO records and local court files can show case-identification, party, attorney, hearing, event, document, financial, and disposition details. The public online version is narrower than the courthouse file because Rule 8 limits remote access to some data and documents. MCRO may show a party as "Name Not Available Online" when the name is restricted from internet display.

A court record also needs context. Case type does not prove the final offense level or outcome. A citation number is different from a court case number. An Active Warrant flag may appear at party level, but the MCRO FAQ warns that the flag may not relate to the case being viewed. A BCA criminal-history search is the official route for public conviction history.

FieldWhat It Means

Lincoln County Court Access Laws

Minnesota law starts from public access, then applies specific limits by statute, court rule, and case type. For Lincoln County court records, the key distinction is courthouse access versus remote access. MCRO gives internet access to many public records, but Minnesota Rules of Public Access decide what may be shown online.

Key Minnesota access rules:

Minn. Stat. section 13.03 says government data is public unless law classifies it otherwise.

Minn. Stat. section 13.82 classifies law-enforcement records such as arrest, request-for-service, and investigative data.

Minn. Stat. section 13.87 governs public criminal-history data through the BCA system.

Rule 8 controls remote online access to court records.

Rule 4 lists non-public court-record categories.

For practical use, search MCRO first, then request official or restricted access through Lincoln County Court Administration. Sheriff data, jail data, and incident records follow law-enforcement data classifications and may require a county data request.

Restricted Lincoln County Records

Not every Lincoln County court record is public online. Juvenile delinquency and child-protection records have separate statutes. Domestic abuse order and harassment restraining order case types are not displayed in MCRO because remote publication is restricted. Civil commitment records, adoption access, sealed cases, confidential files, victim and witness identifiers, Social Security numbers, financial accounts, and some addresses are also limited.

Sealed records require authorized access or a court order. Named parties in a confidential but not sealed case may be able to get records after court administration verifies identity. Criminal expungement may occur by petition under Minn. Stat. section 609A.03 or, for qualifying records, automatic expungement under Minn. Stat. section 609A.015.

Note: If a public online search does not show a case, the record may still exist at the courthouse or be restricted from remote display.

Lincoln County Court Programs

Lincoln County is tied to district-level specialty resources rather than a separate local specialty courthouse. The Minnesota Judicial Branch treatment-court county page lists the Southwest Community Drug Court with Lincoln/Lyon wording and names Alison Salazar as coordinator in Marshall. The same state page also lists the Fifth Judicial District Veterans Court with Kevin Mettler as coordinator in Mankato.

The local court page links to the Fifth Judicial District Ignition Interlock Program. That program serves people who live in the Fifth District or have an open criminal case in the Fifth District. It is most relevant to DWI and traffic-related cases. Family matters may also involve early case management or early neutral evaluation resources.

The Minnesota Board of Public Defense offices page gives district public-defense contacts for criminal and juvenile defense issues.

Public defense is separate from the court and the prosecutor, so eligibility and appointment questions follow the court process.

Lincoln County Jail Records

The Lincoln County Sheriff's Office is the county law-enforcement and jail agency. Sheriff Bob Bushman's office operates a 24-hour 911 communications center, handles traffic enforcement, criminal investigations, accident investigations, civil process, court orders, handgun purchase permits, and permits to carry. The Sheriff's Office also participates in the Buffalo Ridge Drug and Violent Crime Task Force.

The Lincoln County Law Enforcement Center is directly behind the courthouse in Ivanhoe and houses the county jail, communications center, and sheriff staff offices. The jail is designed to hold up to 15 inmates. The sheriff roster shows current custody fields such as JailId, photo, name, charges, current disposition, and total bail. If a person is not listed, call the sheriff, use VINE for custody notices, or use the DOC locator for sentenced state custody.

County inmate details are covered more fully in Lincoln County inmate records, while court-issued warrant issues belong with Lincoln County warrant records.

Marriage Divorce and Probate

Marriage records and divorce records do not come from the same Lincoln County office. Marriage applications, marriage licenses, and certificate searches use the Lincoln County Recorder and Minnesota Official Marriage System. MOMS lists Lincoln County marriage index coverage from 1875 through the current year, but it is an index and does not let users preview the certificate before ordering.

Divorce records are District Court family case records. Certified divorce decrees come from court administration when the needed order is not available as a public online document. Probate, guardianship, conservatorship, trust, and mental-health case categories are district court matters in Lincoln County, with public online access limited by case type and Rule 8.

Testator
A person who made a will.
Executor
The person appointed to manage an estate under a will or court order.
Conservator
A person appointed to handle financial or property matters for a protected person.

Lincoln County Court Fees

Many Lincoln County court records can be viewed online without a document fee, but certified copies and filings have set costs. The Minnesota Judicial Branch copy guidance says plain copies are generally free, certified copies are sealed official copies, and exemplified copies include additional verification. The Lincoln County District Court fee schedule also lists filing and search fees for common case types.

ItemAmount
Plain uncertified copyNo fee
Certified copy$14 per document
Exemplified copy$14 per document
Certified plus exemplified copy$28 per document
Certified judgment search$5 per name
Civil first paper$320
Dissolution filing$400
Conciliation first paper$75

Read Lincoln County Court Records

A Lincoln County court record should be read as a timeline, not just as a search result. The Register of Actions shows the order of filings and events. The complaint starts the claims or criminal charges. A motion asks the judge to take action. An order records the judge's decision. A judgment or disposition shows the result, but that result may apply to one claim or charge rather than the whole case.

For criminal and traffic cases, a charge is not the same as a conviction. A charge may be amended, reduced, dismissed, stayed, or resolved by plea. A payable traffic citation becomes a conviction if paid without a court appearance. BCA criminal history is the better public background-check source because MCRO warns that it should not be used as a background-check service.

Lincoln County Record Limits

Online Lincoln County court records can lag behind courthouse activity. Citations may take up to seven days after the offense to appear for payment. MCRO sessions time out after inactivity. Pending criminal cases without a conviction may not return by defendant name, so case number or citation number can matter. Older pre-July 1, 2015 documents have very limited remote document access.

Errors and missing records should be checked with the originating office. Court case errors go to court administration. Driver record errors go to DVS. Jail custody questions go to the sheriff. Marriage-index questions go to the Recorder or the county that issued the license.

Note: Verify certified records with Lincoln County Court Administration before using online case data for official purposes.

Lincoln County Court History

Lincoln County was established in 1873, and the current courthouse is the county's third courthouse. The Judicial Branch states that the present courthouse was built in 1919 in Beaux Arts style, designed by C. Howard Parson of Minneapolis, and built by Madsen & Peterson of Minneapolis at a cost of more than $200,000. Explore Minnesota describes it as a Bedford granite building listed on the National Register of Historic Places.

The county-seat history includes a midnight move of county records from Lake Benton to Ivanhoe, a detail that makes the courthouse more than a court building. Explore Minnesota also notes the courthouse's links to a murder trial and farm-crisis protests. Modern record access changed again when MCRO replaced MPA Remote, with Document Search, Case Search, Hearing Search, and Judgment Search becoming the current public online routes.

The Lincoln County history page gives local background on the county and courthouse setting.
